CEO Wang Xin was sentenced to 3 years and 6 months in prison, and the company was fined 10 million.
The judgment found that Kuaibo Company has the network security management obligations that an online video information service provider should assume; Kuaibo Company and the defendants were all aware that there were a large number of obscene videos in the Kuaibo network system and were involved in obscene video dissemination activities, and their allowing its network service system to disseminate a large number of obscene videos was indirect intentionality; Kuaibo Company had the realistic possibility to assume network security management obligations but refused to perform network security management obligations, and the actions of Kuaibo Company and the defendants had illegal profit-making purposes.
The Kuaibo case was a key case listed for supervision by the National Anti-Pornography and Anti-Illegal Affairs Office in 2014. The public prosecution agency alleged that the defendant unit Qvod Company and its directly responsible managers Wang Xin, Wu Ming, Zhang Kedong, and Niu Wenju, for the purpose of making profits, knowingly knew that the QVOD media server installation program and Qvod player were used by Internet users to publish, search, download, and play obscene videos, but still allowed them to do so, resulting in a large number of obscene videos being spread on the international Internet.
Quabo Company stated that it pleads guilty and accepts punishment. Wang Xin said, "I also plead guilty and accept punishment. I have no objection to the facts and charges of the accusation." Wang Xin said that during the first court session, "I just said that my point of view at that time was that we did not have any subjective illegal or criminal behavior. I was paranoid that I had not committed a crime." However, after thinking about it, "I think we made certain mistakes in this matter. It is an indisputable fact that we spread obscene videos. After problems occurred, we did not adopt more effective supervision methods."
